Task 1.

GoodRoads Maintenance LLC is a company engaged in road maintenance projects. The company has a contract with Muscat Municipality to maintain roads in Muscat. On 19th March 2017, GoodRoads Maintenance LLC was assigned the project of carrying out maintenance of road No. 3361. Looking to the importance of the road, it was necessary to start work as soon as possible i.e., even before the necessary signs and barriers could be set up. As a measure to avoid accidents and to warn pedestrians about the holes on the road, GoodRoads Maintenance LLC assigned the task of standing and waving the flag alerting users of the danger ahead to Mr. Ali one of the employees. Mr. Ali had an emergency and as there was no one else to replace him left his presence leaving one of the holes unattended.

Mr. Hamed who happened to be walking down that road didn’t see the hole and fell in it and fractured his leg. In addition, his laptop and his new iPhone were damaged beyond repair. At the time of the accident, MR. Hamed was on his way for a job interview in the Ministry of Civil Service. He was one out of 439 applicants selected for a personal interview. Mr. Hamed could not attend the interview because of the accident. He did not get the job, and consequently was not able to go ahead with his marriage plans.

Based on the sequence of events described in the above scenario, perform following tasks:

Task 1

1. By using relevant law to support your answer explain whether Hamed can sue GoodRoads Maintenance LLC? Assuming that, Hamed has a valid claim against GoodRoads Maintenance LLC advise him on the determination ofhis damages. You may use relevant case law to support your answer (1mark + 4 marks = 5 Marks)

2. Explains the elements of negligence Hamed will have to prove while making a claim against GoodRoads Maintenance LLC (You may use relevant case law to support your answer. (6 marks)

3.Explain the defenses available to GoodRoads Maintenance LLC if it decides to defend itself against Hamed’s claim. You may use relevant case law to support your answer. (5 marks)

Task 2.

Nestle was running a special offer whereby members of the public could obtain a music record by sending off three wrappers of Nestle’s chocolate bars within a specified time to a specific address. Mr. Faisal a minor sent three wrappers within stipulated time and claimed his reward. Nestle then rejected his claim stating that he was a minor. Mr. Faisal sued Nestle for breach of contract

1.Explain the importance of the Basic Statue of the State in Oman? (6 marks)
