Fitzwilliam DARCY

STATES:

1. This statement made by me accurately sets out the evidence that I would be prepared, if necessary, to give in court as a witness. The statement is true to the best of my knowledge and belief and I make it knowing that, if it is tendered in evidence, I will be liable to prosecution if I have wilfully stated in it anything that I know to be false, or do not believe to be true.
2. I am 39 years of age.
3. I currently live in the front house of a battle-ax block in Lambton. I live there with my wife and two children aged 2 and 4. I am a self-employed businessman.
4. I have only known my rear neighbour for a week or two as he recently moved in. He lives in the rear house in a battle-ax block. By battle-ax block I mean that my house is on the street front and his house is behind my house, but we share a common driveway. You have to drive down the shared driveway past my house to get to his house.
5. I have had several run ins with him about the driveway. He reverses down the driveway very quickly and it is dangerous for my kids. I have spoken about it with him in the past, but he continues to do it.
6. About 10.30 am on Sunday 9^th February 2020 I was at home inside. My kids were playing on the swing set in the front yard. There is no dividing fence between my front yard and the driveway. I had heard him shouting at his wife shortly before. They often have loud verbal arguments. I heard the car start up and rev loudly. I was concerned that he was angry and going to race down the driveway in reverse and kill my kids.
7. I went outside and sure enough he started to reverse down the driveway very quickly. I made sure the kids were out of the way and I pushed my wheelie bin out into the path of his reversing car to get him to slow down and to teach him a lesson.
8. His car hit the wheelie bin and sent it flying into my front yard.
9. He stopped the car and got out of the driver’s side door and slammed the door like he was really angry. I could see that he had an angry look on his face. He went to the rear of his car and looked at the rear left tail light, which I could see was broken. He picked up the wheelie bin and threw it at me and it nearly hit me. I sent the kids inside and went forward to speak with him.
10. I was still on my front lawn when he came at me yelling, “You dickhead. You broke my tail light”. He grabbed me by the shirt front with his left hand and punched me twice in the mouth with his right fist.
11. I tried to push him away and yelled, “fuck off”. I then fell backwards onto the ground and he fell on top of me. We were wrestling about on the ground for a short while. I was trying to get him off me or stop him from punching me again.
12. The police then came and broke up the fight.
13. The guy who hit me is called George and he lives in the rear house. I have only met him a couple of times.
14. My left cheek and mouth are swollen from where he hit me. At no time did I give him permission to hit me.
